If the Democrats really start talking about prosecuting the Bush administration for “war crimes”…

And they should.

    That may very well be the legacy of the Clinton impeachment… the sense that if they’re going to go after our guy, we’ll go after yours.

    Also, the Digg headline is incorrect in that it says “War Crimes” where the actual article makes no such mention of “War Crimes”, but rather “criminal misconduct” which could also equally apply to other micsonduct of the administration.

    We’ve always had a bright line in American politics, Nick:

    When you win, it’s a clean slate.

    You change the policies of your predecessors…you don’t prosecute them.

    It’s one of the reasons we’ve been able to peacefully pass power back and forth between the two parties.

    But if the people in power might go to prison when they lose an election, staying in power by whatever means necessary becomes a much more attractive prospect.

    Ford pardoned Nixon to avoid setting that exact precedent.

    If you think the other guys are doing wrong, impeach them. Prosecute them when they are in power. Don’t wait until you’re in power and punish the losers.

    If Obama does that, it will become the beginning of the unraveling of our Republic.

    (Yeah, I know that sounds alarmist. But I deeply believe the prospect is that alarming.)
